When a lender, real estate office or another participant in your real
estate settlement refers you to an affiliate for a settlement service (such
as when a real estate salesperson or broker refers you to a mortgage broker
affiliate or a title company affiliate), federal law requires that they give
you an Affiliated Business Arrangement Disclosure. This law requires the
referring company to disclose to their clients and customers the business
relationships and interests that they have with and in the companies with
whom they do business. Further, federal law requires this disclosure to be
made at the time of the referral, not after the fact. Bluntly, this can mean
that the party making the referral may benefit financially to help persuade
you to do business with their "partners" (it is not unusual for referral
compensation -often times money- to be paid between referring parties).
Without disclosure at the time of the referral, this practice is illegal
and is a complete breach of ethics. Logically, at least two questions
come to mind. What could this mean for you? How could this affect your transaction?

market. We think that you should judge someone by the value of their service and not
worry about the value of their possible “kickback.”
Anything that has the possibility of getting in the way of our relationship with you is at best a distraction and at worst a lawsuit for one or both of us. We pride ourselves on the advice we provide to you and want nothing to interfere with it. We are one of the few offices that can make this claim, and the only one (to our knowledge) that will put this assurance in writing.
